Dialost
Dialost takes your privacy very seriously and
treats all your personal information with great care. In order to guarantee
your privacy, Dialost always acts in accordance with the Personal Data
Protection Act (“Wet Bescherming Persoonsgegevens”).
This document sets out Dialost’s Privacy Statement.
It is recommended that you read this Privacy Statement carefully. The
capitalized words are defined in the Terms of Use http://www.dialost.eu/p/privacy-statement.html .
1. Who
is Dialost?
Dialost is a company specialized in the field
of Mobile Traveler Guides. Dialost offers a mobile application (OPAS) that
provides the traveler that uses the Application with information concerning objects
of interest in its environment, based on his current (GPS) location. This
information (Content) is provided by third parties.
Dialost Group B.V., is a company with limited
liability established and existing under the
laws of The Netherlands, having its registered office in (1171KA) Badhoevedorp,
the Netherlands, at Windestraat 12.
2.
What information does Dialost collect and process?
Account
In order to use the Service OPAS, the User must
download the application on his mobile device. An Account can but does not have
to be created in order to use the application. The user can create an Account
or log in using his Twitter-, Facebook-, or Google+-Account. To create an Account
the following information needs to be provided:

Account

Password

Payment
information

Preferred
language

Type of
mobile device
Dialost saves and processes all the supplied
information. The information that is made public, such as the Account, Content,
User-generated Content, may be used by other Users. The information provided by
the User can at any time be changed in the Account or the Account can be
deleted.
After termination of your Account, Dialost shall
automatically remove your Account. Dialost remains entitled to use your
personal information as described above for the purposes as described in this
Privacy Statement. Dialost will, however, upon your request, anonymize or
remove your information.
Link to social media
You can choose to link the Service to your Facebook-,
Twitter-, or Google+-account, so that the Application has access to your information
stored and/or accessible in these Accounts, including your timeline and/or
newsfeed.
For the use of Facebook, Twitter and Google+, you are
bound by the conditions for use of these services. Dialost cannot influence
Twitter, Facebook and Google+ and thus cannot guarantee that these social media
services use you personal data in accordance with the law.
Automatically generated data
Dialost requires certain information in order
for the service to work as optimally as possible (for example, to display Content
correctly and to keep its Service secure). That is why Dialost automatically
collects generated data about your use of its Service. This information
consists of your IP address (an unique number, which makes it possible to
recognize your device), your operating system, your GPS information and the Content
you view on OPAS.
In so far as Dialost uses
this information, the data is always anonymized.

For what purposes will Dialost use information about you?
Dialost may use your personal information for
the following purposes:

To allow
you to use OPAS;

To
communicate with you about OPAS and to respond to any complaints and/or
questions;

To
communicate with you about Dialost and/or its products;
·
To
configure OPAS to your wishes and needs;
·
To suggest
Content to you;
·
To generate
anonymous statistical data;
·
To protect,
adjust and update the Service.
Dialost wishes to inform you on the developments
of its Service. Therefore, if there is a change or an update to the Application,
Dialost will inform you thereof. Also Dialost will inform you on its promotions
and other news. You can register for the newsletter on the Dialost website. If
you do not wish to receive emails of Dialost, you can opt-out in your Account.
Also an opt-out option is provided in every email that Dialost sends you.
Use by third parties
Without your explicit consent Dialost shall not
provide your personal information to third parties for the purpose of direct
marketing.
Dialost may provide your personal data to third
parties if you have given explicit consent to do so and/or if the information
cannot be traced to you (for instance automatically generated information, not
being an IP-adres). Also, Dialost may provide your personal data to third
parties if Dialost is obliged to do so on account of national or international
laws, case law and/or regulations, if Dialost considers it necessary to do so
in defense of its own rights.
OPAS may contain hyperlinks which take you away
from the OPAS environment and to the website or application of a third party. Dialost
has no authority over the services and/or websites of third parties to which is
linked in OPAS. It therefore may be the case that for the use of those services
and/or websites of third parties another privacy statement is applicable. This
Privacy Statement is exclusively applicable to the personal data that is
obtained trough the Service of Dialost. Dialost does not accept any
responsibility or liability for the (use and/or content of the) services and/or
websites of third parties.
4.
How does Dialost protect your personal information?
Dialost takes appropriate technical and
organizational measures to protect your (personal) information against loss or
any form of unlawful use.
5.
Viewing, changing and deleting your data
If you wish to know what information Dialost
has collected about you or if you wish to change data that you cannot change
yourself in your Account, then you can send a request for information on your
personal data to: abuse@dialost.eu. Dialost will respond to your request within 4
weeks. If you then wish to correct, add, remove or screen your personal data,
you may send another request thereto. Dialost shall respond within 4 weeks to
such a request. If Dialost decides to deny your request, it shall inform you on
the grounds of this decision.
6.
Transfer of data to countries outside the EU
For technical and operational reasons, it may
be necessary for your (personal) data to be transferred to (the servers of)
companies affiliated to Dialost located in the United States or other countries
outside of the EU. If this is to happen, the information contained in your Account
will also be saved in a foreign country. Since legislation concerning data
protection may then not offer the same protection as in the European Union, you
hereby agree that your (personal) information can be transferred to the United
States or another country outside of the EU. If Dialost decides to transfer
your data outside of Europe, you shall be informed thereof prior to the
transfer.
8.
May minors use OPAS?
If you have not yet reached the age of sixteen
(16) years, you are obliged to have consent of your parents or legal guardian
prior to creating an Account. By accepting this Privacy Statement, you
guarantee that you are sixteen (16) years old or older or you have permissions
from your parents/legal guardian to create an account.
9.
Can this Privacy Statement be changed?
It is possible for the Privacy Statement to be
amended in the future. That would then be mentioned on this page www.dialost.eu,
so it is recommended to regularly have a look at this page.
